ACCESS TO LANDS AND
SELECTION OF PERSONS FOR ACCESS

          

Remembering MāHUNT’s purpose to procure, put back to wild, propagate, preserve, protect, perpetuate, and pay for isolated natural properties/habitat and archeological/historic resource sites where up to two people at one time per property can commune in (near pristine) nature with solitude, the following selection periods and process shall be available to all American citizens (except those convicted of a felony or willful (non-minor) hunting/fishing violation). MāHUNT reserves the right to deny successful applicants admission to the property/habitat if MāHUNT no longer owns/leases the property/habitat or deems admission overly hazardous or dangerous to entrants. No preference will be given to any individual or group for selection and use of the land:

PROPERTIES LOCATION:

1. MāHUNT (Dunn #1) --- “Dunn #1” is located in the Town of Dunn, Dane County, WI (southeast of Madison, WI and east of McFarland, WI), with its entrance on the south side of Elvehjem Road at the first perpendicular bend.

2. MāHUNT (Dunn #2) --- “Dunn #2” is located in the Town of Dunn, Dane County, WI (south of Madison, WI and south of McFarland, WI) at 2770 E. Tower Road --- approximately one mile south of McFarland’s stop light on U.S. Highway 51 --- with the entrance at the east end of East Tower Road.

3. MāHUNT (Dunn #3) --- “Dunn #3” is located in the Town of Dunn, Dane County, WI (south of Madison, WI and northeast of Oregon, WI) at 4243 Schneider Drive --- with the entrance to the south off Schneider Drive which runs east/west north of Stoughton and Oregon, WI.

4. MāHUNT (Dunn #4) --- “Dunn #4” is located in the Town of Dunn, Dane County, WI (in the east-middle of Hook Lake, which abuts the south end of Dunn #3).

5. MāHUNT (Dunn #5) --- “Dunn #5” is located in the Town of Dunn, Dane County, WI (south of Madison, WI and south of McFarland, WI) at 2727 U.S. Highway 51 --- approximately one mile south of McFarland’s stop light on U.S. Highway 51 --- with its entrance approximately 100 feet west of U.S. Highway 51 on West Tower Road.

ADMITTANCE PERIODS

1) During the Viewing Educational Period (“VEP”) of the year, the properties/habitat of MāHUNT shall be available for up to two people at one time per property to commune in (near pristine) nature with solitude as sanctified sites (no hunting/trapping permitted). For Dunn #1, Dunn #2, Dunn #3, and Dunn #5, the times available each year for the above VEP shall be:

• From January 1st through March 31st and June 1st through August 31st of each year.

2) During the Caretaker Period (the “Caretaker Period”), on all Mondays during the year, no humans from the public shall be allowed admittance to MāHUNT’s properties (except the 120 foot radius semi-circle of land with its center being the West edge of Fox Run (street) where it abuts Dunn #1’s property/habitat, where up to 50 people overseen by their teacher(s) or parent(s) at one time can learn about the subject property, its eight Indian Mounds and Native Americans’ history and MāHUNT’s museum/retail area on Dunn #5) to allow the property a further respite and to allow the caretaker(s) to enter the property (if deemed necessary) to inspect and maintain the property.

3) During the Guardian Educational Period (the “GEP”), the properties/habitat of MāHUNT shall be available for up to two people at one time per property to commune in (near pristine) nature with solitude as sanctified sites and to hunt/trap ethically and legally. For Dunn #1, Dunn #2, Dunn #3, and Dunn #5, the times available each year for the above GEP shall be:

• From April 1st through May 31st and September 1st through December 31st of each year.

ADMITTANCE PROCESS

There shall be two ways to gain admittance to MāHUNT’s properties/habitat. In both instances, the following shall apply:

(i) Submission of applications for any calendar year shall be received by MāHUNT by September 15th of the prior year (e.g., September 15, 2005 for 2006).

(ii) Notice of success or non-success and refunds (if applicable) shall be mailed to applicants prior to November 15th of the year of submission.

Officers, Directors, caretakers, agents, employees and independent contractors of MāHUNT shall have the same opportunity (no more-no less) than any other member of the public to gain admittance under the above two ways. No substitution of applicants is permitted from those specified in the application.

A lifetime ban from access on any and all of MāHUNT’s properties/habitat shall result for any entrant to the property/habitat or any member of the public if such person shall:

(I) make false, or misleading statements or attestations on any application submitted to MāHUNT,

(II) violate any of the Log or Hunting Log Book’s rules or a specific property’s attached restrictions and warnings,

(III) have been or be convicted of willfully violating any (non-minor) state or federal hunting/fishing/poaching violation,

(IV) trespass on the property.

(V) have pursued litigation against MāHUNT or its officers, directors, or caretakers in their capacity with MāHUNT.

(VI) owe money to MāHUNT that has been unpaid for over 180 days from MāHUNT’s written request for repayment.

Each property’s caretaker(s) determination of (II) and/or (IV) above shall be dispositive if made in good faith from direct observation or direct evidence.

As attested to on the application form for the free draw and agreed by signing the Log Book or Hunting Log Book, any violation of any of the Log Book or Hunting Log Book’s rules or a specific property’s attached restrictions and warnings shall result in the individual violating such rule (and/or the group that such individual states that he/she represents) paying to MāHUNT treble damages plus legal fees.

The application for the GEP shall also include a copy of:

A) his/her and any human companion’s previous license (unless the companion was younger than the minimum age to receive a hunting license at the time of the application) for the State and largest species which may be legally sought by the same method intended by the applicant or human companion during the period sought on MāHUNT’s properties/habitat from either of the two prior years’ or the current year’s comparable hunting seasons (e.g. (1) a goose license from Wisconsin from a prior year will permit duck, goose, or pheasant hunting with a shotgun with shot on MāHUNT’s properties/habitat during the bow deer season and during the shotgun slug deer season, (2) a fall deer bow hunting license from Wisconsin from a prior year will permit fall deer bow hunting on MāHUNT properties/habitat, but a fall gun or rifle license from a prior year will not be sufficient for a bow fall deer hunt on MāHUNT’s properties/habitat, or (3) a small game Wisconsin hunting license is sufficient for entrants who do not hunt on MāHUNT’s properties/habitat during this period).

B) his/her and any human companion’s unsuccessful notification (or refund) for the State and largest species by the same method intended by the applicant or human companion which may be legally sought during the period in situations where limited hunts were involved where less than all applicants were sold licenses or permits from either of the prior two years.

The copies required in A and B above need not prove that the applicant(s) actually hunted in one of the prior two years, but rather than such applicant contributed money through license purchases to benefit the wildlife and habitat in the State where the license was purchased.

Either the applicant or human companion may enter successfully drawn property/habitat alone, so long as the human companion is at least eighteen (18) years of age in the entry date.

A successful applicant (whether for the free draw or blind cash bid) may change the human companion or add a human companion (if the successful applicant applied alone) between notification of success and entry to the property/habitat if:

1) MāHUNT receives a new application completely filled out for the exact same dates and property/habitat with both the applicant's new signature and the new companion’s signature on both the application and the waiver and consent (and if during the Guardian Education Period—with copies of the new companion’s appropriate hunting licenses attached) prior to entrants' entry into the property/habitat or attached to entrants' applicable sign-in sheet.

Individual applicants may submit up to seven applications per property, as applicant or human companion of applicant, for each available MāHUNT property/habitat for the free draw and blind cash bid during each year for the following year, (e.g., for example, an individual could be an applicant for Dunn #5 for four, three-day periods under the free draw and one, three-day period under the blind cash bid).

Applicants shall rank their preference for entry for each application for each property. For example, if applicant Joe Everyperson wants to submit five (5) applications for the free draw for Dunn #1 and two (2) applications for the blind cash bid for Dunn #1, he must rank his preference for each period from one (1) through seven (7).

If two or more applicants submit applications for the same period under the free draw, the applicant with the higher rank preference (rank #1 is highest and #7 is lowest) shall be awarded the period. If two or more applicants submit applications for the same period under the free draw and rank such application at the same preference, MāHUNT’s Treasurer shall draw the winning applicant on a random basis: For example:

Joe Everyperson applies for the free draw for Dunn #1 for November 1, 2, and 3 and ranks it #2,
John Friendly applies for the free draw for Dunn #1 for November 1, 2, and 3 and ranks it #3,
Jill Hunter applies for the free draw for Dunn #1 for November 1, 2, and 3 and ranks it #2.

John Friendly would not win the free draw, but rather either Joe Everyperson or Jill Hunter would be randomly drawn by MāHUNT’s Treasurer to win entry on November 1, 2, and 3 to Dunn #1.

Applicants not specifying a preference rank on their application for the free draw, shall have their preference rank inserted by MāHUNT’s Treasurer with the latest date in the calendar year garnering the highest preference rank. For example if Jim Quickread fails to list a preference rank for his two applications for the free draw to Dunn #2 for November 8, 9, and 10 and for December 1, 2, and 3, MāHUNT’s Treasurer shall assign a preference rank of #1 for the December 1, 2, and 3 period and #2 for the November 8, 9, and 10 period.

The blind cash bid shall be affected by its preference rank only when the blind cash bid is the highest and two or more applicants bid the same highest amount. The applicant with the higher preference rank shall be awarded entry, unless such applicants have ranked their preference for the period exactly the same. In which case MāHUNT’s Treasurer shall randomly select the winning blind cash bid.

FREE DRAW PROCEDURES

1. The free draw shall be for any three day period during the year which is a consecutive Friday, Saturday, and Sunday, whether being during the VEP or the GEP, or during a combination of the two periods. No deposit shall be required to make such application for such free draw or to enter the property if successful.

A free draw for no cost of admittance by any American citizen not convicted of a felony, DUI, use of possession of a gun in the commission of or during a crime, use or possession of illegal drugs, perjury, suborning of perjury, obstruction of justice, willful violation of any Federal or State hunting/fishing/poaching regulations not inadvertent or minor, (e.g., using a barbed fly if in an unmarked barbless fly fishing only water), any hunter harassment or associated laws, or any willful illegal activities while defending "animal rights." Submissions for this draw shall be made to a FREE DRAW, Post Office Box 628426, Middleton, Wisconsin 53562-8426. Such submission shall require:

A) The specific property requested;

B) The dates requested;

C) A signature by the applicant and companion, as well as the address and telephone number of both parties and a statement that same shall not have been convicted of any of the crimes listed in paragraph 1 above;

D) The age of each applicant (applications submitted by individuals under 18 years of age as applicant or human companion of applicant must be approved and co–signed by an adult guardian, accepting all responsibility for the actions of such individual under 18 years of age and agreeing to accompany and proximately supervise such individual under 18 at all times on the property(ies)/habitat); and

E) Attestation that applicants have read and will abide by the Rules/Log Book, including its respective Specific Property/Habitat Restrictions and Warnings for the VEP and the Rules/Hunting Log Book, including its respective Specific Properties/Habitat Restrictions and Warnings for the GEP, including signing same upon each entrance to the property and signing same and completing the questionnaire in its entirety upon each exit from the property.

BLIND CASH BID PROCEDURES

2. The blind cash bid shall be for any three day period during the year which is a consecutive Tuesday, Wednesday and Thursday, whether being during the VEP or the GEP, or during a combination of the two periods.

The blind cash bid is a donation for use by MāHUNT for management and conservation of the resources on the properties and is not payment for the right to visit or hunt/trap on the properties. The highest blind cash bid will be allowed admittance for the cost specified in the bid by any American citizen not convicted of a felony, DUI, use or possession of a gun in the commission of or during a crime, use or possession of illegal drugs, perjury, suborning of perjury, obstruction of justice, willful violation of any Federal or State hunting/fishing/poaching regulations not inadvertent or minor (e.g. using a barbed fly if in an unmarked barbless fly fishing only water), any hunter harassment, damage or defacement of hunting trophies or fur garments, or associated laws or any willful illegal activities, especially while defending or advocating "animal rights." Submissions for this draw shall be made to BLIND CASH BID Post Office Box 628426, Middleton, Wisconsin 53562-8426. Such submission shall require:

A) The specific property requested;

B) The dates requested;

C) A signature by the applicant and the human accompanying the applicant, if successful attesting, that each has not been convicted of any of the crimes set forth in 2. Above;

D) A personal check for the amount of the bid plus $100.00 as a refundable deposit. The entire amount of the check shall be returned promptly if the applicant is not the highest bid or in the event of a tie with the highest preference rank (or if not randomly drawn when two or more bid and preference ranks are the same). The refundable deposit will be returned in full within 90 days of the visitation if no damage occurred to the property during their three days from their activities and in part or none to offset treble any damages resulting from their activity during their three days. Any violation of any of the Log Book’s or Hunting Log Book’s, including its respective Specific Properties/Habitat Restrictions or Warnings, shall result in a forfeiture of said $100.00. If $100.00 is insufficient to repay treble the damages incurred, MāHUNT may pursue the applicant and human accompanying party for the remaining treble damages due above the $100.00;

E) The age of each applicant (applications submitted by individuals under 18 years of age as applicant or human companion of applicant must be approved and co-signed by an adult guardian, accepting all responsibility for the actions of such individual under 18 years of age and agreeing to accompany and proximately supervise such individual under 18 at all times on the property(ies)/habitat); and

F) Attestation that applicants have read and will abide by the Rule/Log Book for the VEP and the Rule/Hunting Log Book, including the Specific Properties/Habitat Restrictions and Warnings, for the GEP, including signing same upon each entrance to and signing same and completing the questionnaire in its entirety upon each exit from the property.

Any moneys received from the highest cash blind bids shall fund the caretaker’s activities or restore habitat and thereby will be used to maintain the respective property.

Officers, Directors, caretakers, agents, employees and independent contractors of MāHUNT shall have the same opportunity (no more-no less) than any other member of the public to gain admittance under the above two ways.
