ACCESS TO LANDS AND SELECTION OF PERSONS FOR ACCESS

Remembering MAHUNT’s purpose of procuring, restoring, propagating, preserving, perpetuating, and paying for isolated natural property(ies)/habitat and archeological/historic resource sites where up to two people at one time per property can commune in (near pristine) nature with solitude, the following selection periods and process shall be available to all American citizens (except those convicted of a felony or willful (non-minor) hunting/fishing violation). No preference will be given to any individual or group for selection and use of the land:

PERIODS

1) Approximately 61% ("61% period") of the year, the property(ies)/habitat of MAHUNT’s shall be available for up to two people at one time per property to commune in (near pristine) nature with solitude as sanctified sites (no hunting/trapping permitted).

The times for each property may differ. For the original property, the times available each year (if money is available to fund the draw/bid for the entire year) for the above 61% period shall be:

A) From January 1 through the penultimate Sunday in April (16 weeks in 2000);

B) from the day after the first Sunday in May through the day before the last Saturday in September, (21 weeks in 2000);

C) from the third Monday in October through the fourth Monday in October (1 week in 2000); and

D) the week ending the Sunday before Christmas (starting the Monday before) (1 week in 2000).

2) Approximately 14% of the year ("14% period"), on all Mondays during the year, no humans from the public shall be allowed admittance to the property (except the 120 foot radius semi-circle of land with its center being the West edge of Fox Run (street) where it abuts the original property/habitat, where up to 50 people overseen by their teacher(s) or parents) at one time can view the Museum, learn about the original property, Indian Mounds and Native Americans' history) to allow the property a further respite and to allow the caretaker(s) to enter the property (if deemed necessary) to inspect and maintain the property.

3) Approximately 25% of the year ("25% period") the property(ies)/habitat of MAHUNT’s shall be available for up to two people at one time per property to commune in (near pristine) nature with solitude as sanctified sites and hunt/trap ethically and legally.

The times for each property may differ. For the original property, the times available each year (if money is available to fund the draw/bid for the entire year) for the above 25% period shall be:

A) From the Tuesday following the second Sunday in April through the second Sunday in May (24 days in 2000);

B) from the last Saturday in September through the Sunday before the third Monday in October (14 days in 2000);

C) from the Tuesday following the fourth Monday in October through the Sunday before the Sunday before Christmas (42 days weeks in 2000); and

D) from the Tuesday following the Sunday before Christmas through December 31st (10 days week in 2000).

PROCESS

There shall be two ways to gain admittance to MAHUNT’s property(ies)/habitat. In both instances, the following shall apply:

(i) Submission of applications for any calendar year shall be received by MAHUNT by September 15th of the prior year.

(ii) Notice of Success only shall be mailed to successful applicants prior to November 15th of the year of submission.

Officers, Directors, caretakers, agents, employees and independent contractors of MAHUNT shall have the same opportunity (no more-no less) than any other member of the public to gain admittance under the above two ways. No substitution of applicants is permitted from those specified in the application.

A lifetime ban from access on any and all of MAHUNT’s property(ies)/habitat shall result for the applicant and human companion if either shall:

(I) make false, or misleading statements or attestations on any application submitted to MAHUNT,

(II) violate any of the log or hunting log book's rules or a specific property's attached restrictions and warnings,

(III) have been or be convicted of willfully violating any (non-minor) state or federal hunting/fishing/poaching violation,

(IV) trespass on the property.

The caretaker(s) determination of (II) and/or (IV) above shall be dispositive if made in good faith from direct observation or direct evidence.

As attested to on the application form for the free draw and agreed by signing the log or hunting log book, any violation of any of the log or hunting log book's rules or a specific property's attached restrictions and warnings shall result in the individual violating such rule (and/or the group that such individual states that he/she represents) paying to MAHUNT treble damages plus legal fees.

The application for the 25% period shall also include a copy of:

A) his/her and any human companion's previous license for the State and largest species which may be legally sought by the same method intended by the applicant or human companion during the period sought on MAHUNT’s property(ies)/habitat from either of the two prior years' comparable hunting seasons (e.g. (1) a goose license from Wisconsin from a prior year will permit duck, goose, or pheasant hunting with a shotgun with shot on MAHUNT’s property(ies)/habitat during the bow deer season but not during the shotgun slug deer season, or (2) a fall deer bow hunting license from Wisconsin from a prior year will permit fall deer bow hunting on MAHUNT property(ies)/habitat, but a fall gun or rifle license from a prior year will not be sufficient for a bow fall deer hunt on MAHUNT’s property(ies/habitat), or

B) his/her and any human companion's prior two years' application and its unsuccessful notification (or refund) for the State and largest species by the same method intended by the applicant or human companion which may be legally sought during the period in situations where limited hunts were involved where less than all applicants were sold licenses or permits.

The copies required in A and B above need not prove that the applicant(s) actually hunted in one of the prior two years, but rather than such applicant contributed money through license purchases to benefit the wildlife and habitat in the State where the license was purchased.

1. A free draw for no cost of admittance by any American citizen not convicted of a felony, DUI, use of possession of a gun in the commission of or during a crime, use or possession of illegal drugs, perjury, suborning of perjury, obstruction of justice, willful violation of any Federal or State hunting/fishing/poaching regulations not inadvertent or minor, (e.g., using a barbed fly if in an unmarked barbless fly fishing only water), any hunter harassment or associated laws, or any willful illegal activities while defending "animal rights." Submissions for this draw shall be made to a post office box to be established and specified by MAHUNT in the future. Such submission shall require a signature by the applicant and companion, as well as the address and telephone number of both parties and a statement that same shall not have been convicted of any of the above in this paragraph.

The free draw shall be for any three day period during the year which is a consecutive Friday, Saturday, and Sunday, whether being during the 61% period or the 25% period, or during a combination of the two periods. No deposit shall be required to make such application for such free draw or to enter the property if successful. Preference shall be given to a student from McFarland High School for the free draw for the original property for the twenty-five percent (25%) period first three day period in 3A above and the second three day period in 3B above.

Individual applicants may submit up to five applications total, as applicant or human companion of applicant, for all MAHUNT’s properties/habitat for the free draw during each year for the following year. Such applicants may not submit any blind cash bids as applicant or human companion of applicant (outlined below) during any year in which they submit any applications for the free draw for any of MAHUNT’s property(ies)/habitat. Successful applicants may visit the property(ies)/habitat with or without their companion, but a companion must always be accompanied by a successful applicant. Applications submitted by individuals under 18 years of age as applicant or human companion of applicant must be approved and co-signed by an adult guardian, accepting responsibility for the actions of such individual under 18 years of age and agreeing to accompany such individual under 18 at all times on the property(ies)/habitat.

2. The blind cash bid is a donation for use by MAHUNT for management and conservation of the resources on the property(ies) and is not payment for the right to hunt/trap on the property(ies). The highest blind cash bid will be allowed admittance for the cost specified in the bid by any American citizen not convicted of a felony, DUI, use or possession of a gun in the commission of or during a crime, use or possession of illegal drugs, perjury, suborning of perjury, obstruction of justice, willful violation of any Federal or State hunting/fishing/poaching regulations not inadvertent or minor (e.g. using a barbed fly if in an unmarked barbless fly fishing only water), any hunter harassment or associated laws or any willful illegal activities while defending "animal rights." Submissions for this draw shall be made to a post office box to be established and specified by MAHUNT in the future. Such submission shall require:

A) a signature by the applicant and the human accompanying the applicant if successful attesting that each has not been convicted of any of the crimes set forth in 2. above,

B) a personal check for the amount of the bid plus sales tax plus $100.00 as a refundable deposit. The entire amount of the check shall be returned promptly if the applicant is not the first bid received at the highest price. The refundable deposit will be returned in full within 90 days of the visitation if no damage occurred to the properties during their three days from their activities and in part or none to offset treble any damages resulting from their activity during their three days. Any violation of any of the log book's or hunting lot book's rules or specific property's attached restrictions or warnings shall result in a forfeiture of said $100.00. If $100.00 is insufficient to repay treble the damages incurred, MAHUNT may pursue the applicant and human accompanying party for the remaining treble damages due above the $100.00.

Any moneys received from the highest cash blind bids shall fund the caretaker's activities listed in a through j under CARE OF LAND in Attachment C hereof and thereby will be used to maintain the respective property.

The blind cash bid shall be for any three day period during the year which is a consecutive Tuesday, Wednesday and Thursday, whether being during the 61% period or the 25% period, or during a combination of the two periods.

Submission of applications for any calendar year shall be received by MAHUNT by September 15 of the prior year. Notice of success and refunds shall be mailed back to applicants prior to November 15 of the year of submission.

Individual applicants may submit up to a total of five (5) applications, as applicant or human companion, for all MAHUNT properties/habitat for the blind cash draw during each year for the following year. Such applicants may not submit any free draw bids as applicant or human companion to applicant (outlined above) during any year in which they submit any applications for the blind cash draw for any of MAHUNT’s property(ies)/habitat. Successful applicants may visit the property(ies)/habitat with or without their companion, but a companion must always be accompanied by a successful applicant. Applications submitted by individuals under 18 years of age as applicant or human companion of applicant must be approved and co-signed by an adult guardian, accepting responsibility for the actions of such individual under 18 years of age and agreeing to accompany such individual under 18 at all times on the property(ies)/habitat.
