Under 501(c)(3) of the Internal Revenue Code MAHUNT ATTACHMENT C Part II Activities and Operational InformationItem 1: Detailed and narrative description of organizations activities: 2. The possible site of an 1832 skirmish in the Blackhawk War, where Jefferson Davis served as Battalion Commander and Abraham Lincoln reported as Captain. Four sizeable tomahawk heads found by Lloyd A. Schneider in a 50 foot circle in the east central part of the property (believed from such skirmish) are anticipated to be displayed in a museum (the "Museum") intended to be located on the original property. 3. Abundant wildlife/habitat, native plants and trees, and a wetland. The property/habitat generally has squirrels, rabbits, pheasants, mink, muskrats, raccoons, sandhill cranes, mallards, woodducks, and whitetail deer. It also lies under a primary flyover area for a native flock of giant Canada Geese which periodically land on the property/habitat. A legal description of the original plot of land is marked Exhibit VII and attached hereto (the "Property"). The Museum mentioned is presently anticipated to contain Native American artifacts found on the original plot, educational information regarding the Indian mounds located on MAHUNT 's property(ies)/habitat and examples/art depicting the wildlife/habitat and flora found over and on MAHUNT's property(ies)/habitat and in North America. It is hoped that in the future, educational programs will be conducted for schools in the area regarding the property's Native American history. The Board of Directors of the Foundation (the "Board") shall consist of members of the Lloyd and Daphne Schneider family because of their special knowledge and expertise in the preservation and protection of wild lands and the natural use of open spaces for hunting and outdoorsmanship. The Board intends to minimize its money raising expenses as a percent of contributions while engaging in a well-designed plan for solicitation of funds first within the areas near the property(ies)/habitat to be preserved and then spreading out to attract additional property(ies)/habitat and broader membership. The three original members of the Board presently anticipate contributing $3,000 in cash and/or publicly traded securities (in addition to the initial property estimated to be valued at $250,000 contributed by James A. Schneider) to the Foundation upon receipt of the 501(c)(3) designation. Daphne H. Schneider will also make loans of $13,000 FORM 1023 Application for Recognition of Exemption MAHUNT ATTACHMENT C Part II Activities and Operational InformationItem 1: Detailed and narrative description of organizations activities: and $35,000 to the Foundation within the next month and upon receipt of recognition as a 501(c)(3) charitable foundation, respectively. The loan is anticipated to be for a two year period at an interest rate of 6% payable in quarterly installments that will equal 80% of the Foundation's revenue from disqualified contributions, membership fees, public or 501(c)(3) organizations' contributions and unusual gifts (if any) received during the preceding quarter. The loan and accrued interest will be payable in whole at any time by the Foundation without penalty.
SPECIFIC PURPOSES AND ACTIVITIES: The Initial Directors have created a program of several activities and procedures for procuring, preserving, visiting and experiencing its protected property(ies)/habitat that will allow a broad section of the public to participate in and involve and educate the community(ies) surrounding the property(ies)/habitat, as well as individuals far distant from the property(ies)/habitat, to fulfill the charitable and educational purposes of the Foundation. The purposes and activities are set forth in detail below. a. To procure, restore, propagate, preserve, perpetuate, and pay for isolated natural property(ies)/habitat and archeological/historic resource sites where up to two people (from artists to Zuni) at one time per property/habitat can commune in (near pristine) nature with solitude, to establish museum(s) for displaying their attributes and foster scientific research to improve such property(ies)/habitat, while connecting with "everyman/everywoman" who care about saving land/habitat. Robert Marshall stated "There are certain things that cannot be enjoyed by everybody. If everybody tries to enjoy them, nobody gets any pleasure out of them." Approximately eighty (80%) percent of the resources and seventy-five (75%) percent of the time by the President, the Board, volunteer and hired independent contractors and/or staff during each year will be dedicated to this purpose, beginning as soon as practicable upon receiving 501(c)(3) designation, primarily in Wisconsin, Iowa, Montana, California, Arizona, Wyoming, Minnesota, and Illinois. To honor, revere, experience and enjoy our predecessors' sanctified mounds, sculptured artifacts, pristine habitat, and hallowed hunting forever through preserving the balance of land, habitat, native plants and wildlife that they cherished, respected and loved that sustained them and defined their and our etess (eternal essence). The Foundation shall establish the Museum on the original property as soon after receipt of its 501(c)(3) designation as reasonably possible in a portion of an existing structure located on the northwest portion of the original property, approximately 60 feet inside the gate that abuts Fox Run (street) in the Village of McFarland. The Foundation shall simultaneously designate a semi-circle of land with its center being the west edge of Fox Run (street) where it abuts the original property and a radius of 120 feet that shall encompass the Museum where up to fifty (50) people (anticipated to be mostly school children and young adults from Wisconsin overseen by their teachers or parents ) at one time may enter the property on Mondays to view the Museum and learn about the original property/habitat, its Indian Mounds, and Native Americans' history on certain agreed dates with the caretaker(s) or Director(s) of MAHUNT. Approximately seven (7%) percent of the resources and five (5%) percent of the time by the President, volunteer staff, hired independent contractors and/or staff, including a caretaker during the entire year will be dedicated to these activities. The activities are scheduled to begin January 1, 2000 following a September 15, 1999 draw and bid, as described in c. below, available to any American citizen (with the exception of those convicted of a felony crimes or willful (non-minor) hunting/fishing violations). c. To provide and protect land/habitat of solitude for "everyman"/"everywoman" plus up to one human companion to tranquilly meditate etess. An emphasis of fostering and maintaining a calm, quiet atmosphere on the property(ies)/habitat during the major portion of each year will ensure the tranquility and minimal disturbance of wildlife and encourage a peaceful mind and health through thinking "calm brain, no pain" for the humans on the property(ies)/habitat. It is intended that entrants to the property(ies)/habitat should be afforded authentic liberation and genuine pleasure rather than a mere distraction or escape. Another example of such meditation could be the particularly special focus of fly fishing (another holy hunt) on Mud Lake (which abuts the Foundation's original property/habitat) where learning to fly cast a popper for bluegills and blackbass may baptize a lover of nature as a precursor for fly fishing trout, steelhead, and Atlantic salmon with a dry or wet fly. FORM 1023 Application for Recognition of Exemption MAHUNT ATTACHMENT C Part II Activities and Operational InformationItem 1: Detailed and narrative description of organizations activities: Approximately three (3%) percent of the resources and five (5%) percent of the time by volunteered, hired staff, and the caretaker(s)will be dedicated to these activities. The entire year (except for all Mondays) will be made available (1) through a free draw for visitation by any American citizen, to be joined by up to one human companion, neither of which has been convicted of a felony or any willful (non-minor) hunting/fishing violation, for any consecutive Friday, Saturday, and Sunday of the year to commune on the property(ies)/habitat, and (2) the highest blind cash bid will be accepted from any American citizen, to be joined by up to one human companion, neither of which has been convicted of a felony or any willful (non-minor) hunting/fishing violation, for any consecutive Tuesday, Wednesday, and Thursday of the year to commune on the property(ies)/habitat. The free draw and blind cash bid visitations shall commence after the Foundation has sufficient funds to cover administration costs associated with the processing of such submissions and activities which is anticipated to be available by September 1, 1999. Until that time, the property(ies)/habitat shall not be visited by anyone, except the caretaker(s) exercising their duties. If, at any time thereafter, the Foundation has insufficient funds according to the Board, the property(ies)/habitat shall not be visited upon by anyone, except the caretaker(s) exercising their duties. However, the Board shall have the right to cut all trees legally permitted and to sell any and all property(ies)/habitat if any direct education of d. below is prohibited by law on any of MAHUNT's properties/habitat or to generate funds to meet the visitation prescribed in this Purpose c. If any direct learning described in d. below is prohibited, not permitted, or does not take place for twenty-four (24) consecutive months on any MAHUNT property(ies)/habitat, the Board shall (1) allow all entrants under the free draw or blind cash bid to legally shoot skeet or trap (clay pigeons) without regard to the noise restrictions on such property(ies)/habitat as much as they wish and are legally permitted to do during the 61% or 25% period in the area where hunting was permitted previously, or (2) de-acquire the subject property under the criteria for acquisition/de-acquisition, or (3) if (1) above is not legally permitted and (2) above cannot be accomplished after attempting for three years, then the property shall not have any visitors and no caretaker activity, except stopping trespassing, until such sale under (2) is completed. In every circumstance, except selling the property, the Foundation should resist, fight, and stop any annexation to where hunting/trapping is not permitted on any and all MAHUNT property(ies)/habitat or any eminent domain condemnation. FORM 1023 Application for Recognition of Exemption MAHUNT ATTACHMENT C Part II Activities and Operational InformationItem 1: Detailed and narrative description of organizations activities: d. to educate the public (especially children and young adults) on the importance and sanctity of past and continued ethical regulated licensed hunting in the United States of America. The public will be given an opportunity to learn to cherish and glorify hunting's etess both directly by the ritual of legal hunting on these land(s)/habitat or indirectly through hearing/viewing talks, radio, TV, newspapers, films, books, articles, cartoons, websites or any other forms of communication or research/studies. Emphasis will be placed on remembering and honoring hunter's and hunting's essence of self-reliance in building this country, molding the American character, and nurturing our independent spirit, in taking care of wildlife/habitat like no other group, in spawning and being a force for conservation, in practicing freedom of religion, and in nurturing democracy for all -- rich and poor. The legacy that London's famous parks of today were initially hunting areas preserved from development by hunters (royalty) must endure: 1. St. James Park was the King of England's favorite deer and waterfowl hunting area in the 1600's, while 2. Hyde Park/Kensington Palace area were a special waterfowl hunting area for the King of England in the 1700's. Although these hunting areas became encompassed by urban London, utilized by the multitudes at one time, and hunting dropped from their use, the property(ies)/habitat of MAHUNT, even if it becomes surrounded by suburban or urban sprawl shall continue to be used for hunting and communing, but in no event by more than two people at any one time. Like the Statue of Liberty's symbol of democratic freedom for all citizens in the United States of America, hunting on MAHUNT's property(ies)/habitat must remain available to all Americans (except these convicted of a felony or any willful (non-minor) hunting/fishing violations), thereby linking us today with the French that gave us the Statue of Liberty and the peasants that did not join the French Revolution for democracy until they were promised the right to hunt, since previously hunting had only been the purview of property owners (the rich). FORM 1023 Application for Recognition of Exemption MAHUNT ATTACHMENT C Part II Activities and Operational InformationItem 1: Detailed and narrative description of organizations activities: "In a civilized and cultivated country, wild animals only continue to exist at all when preserved by sportsmen. The excellent people who protest against all hunting and consider sportsmen as enemies of wildlife are ignorant of the fact that in reality the genuine sportsman is, by all odds, the most important factor in keeping the larger and more valuable wild creatures from total extermination." President Theodore Roosevelt With large corporations and rich individuals gobbling up property to keep everyone out and conservancies, big government and its agencies devouring land through purchase and eminent domain condemnations to let everyone in, there must be places preserved for "everyman\everywoman" plus up to one human companion to use unbothered by his/her brethren. Our children, their children and their children's children must have areas preserved for solitude. Asphalt cannot be the last crop. Legal trapping (another holy pursuit) shall be permitted on all MAHUNT property(ies)/habitat where legally allowed. It shall be respected just as Sacajawea (the heroine who saved Lewis and Clark) is now and was when she trapped, dressed the skins and made the ermine and weasel coats that saved Lewis and Clark. Approximately three (3%) percent of the resources and five (5%) of the time by the President, volunteer staff, and the caretaker(s) will be dedicated to supporting the direct hunting/trapping by the public which will be allowed, but not required, for entrance on MAHUNT's property(ies)/habitat approximately twenty-five (25%) percent of the days of the year, starting January 1, 2000 following a September 15, 1999 draw and bid. e. To provide and protect land/habitat of solitude for "everyman/everywoman" plus up to one human companion to respect and honor all birds and animals and to be allowed the choice to share the hunt, ("A primal part of Mother Nature's Ways", Why We Hunt, by Dennis Dunn) its plan/spirit, and the most natural healthy unadulterated food (nearly half of the 50 million pounds of antibiotics produced in the U.S. are used in farm animals, mostly as food additives to promote growth) from its effort, thought, skill and care as an unbroken bond with our past as the most uplifting, refreshing, and nourishing experience of life that simultaneously gives awe, meaning, and health to mind, etess, and body. FORM 1023 Application for Recognition of Exemption MAHUNT ATTACHMENT C Part II Activities and Operational InformationItem 1: Detailed and narrative description of organizations activities: Such reverent hunt (especially with bow and arrow) also links us to our predecessors on this land who left their arrowheads (many found on the original property/habitat are expected to be displayed in the presently intended Museum mentioned above) as tangible holy grail of their communion with the blood of death and life (nature's code of kill or die) and who preserved wild turkey feathers like the Zuni of today for holy prayer sticks. "Everyman/everywoman" must remember that the hunt can be successful, satisfying, and wholly enjoyable without killing, although that must be one of the pursuits. The honing, magnifying, sensitizing, and alerting of all of "everyman's/everywoman's" senses during the hunt should carry over to his/her meditative time and every day experience to enhance his/her awareness of beauty, ability to survive and flourish in a complex world, and expertise in serving as a focused sentinel of nature's holy essence. These hunts will also lower the 500,000 cars damaged per year in the United States by collisions with deer and lessen the attendant injury to humans and waste of animals. Two (2%) percent of the resources and four (4%) percent of the time by any American citizen not convicted of a felony or any willful (non-minor) hunting/fishing violation under the draw/cash blind bid system outlined in (c) above beginning January 1, 2000. f. To contribute money, property, time, or advice to MAHUNT's subordinate entities, FNAWS, Ducks Unlimited, Pope & Young Trust Fund, Wildlife Conservation Fund of America, Sportsmen's Wildlife Foundation, Steelhead Society, National Wild Turkey Foundation, Conservation Force, Ruffed Grouse Society, Atlantic Salmon Federation, Congress Sports Foundation, Quail Unlimited, Rocky Mountain Elk Foundation, Resource Renewal Institute (Leopold), Trout Unlimited, Pheasants Forever, The Conservation Fund, and outdoor facilities of public school(s) in the area of any of MAHUNT's property(ies)/habitat and any chapters of the above 501(c)(3) organizations. Approximately three (3%) percent of the resources and four (4%) percent of the time by the resident, volunteered or hired staff during the entire year, beginning as soon as possible upon FORM 1023 Application for Recognition of Exemption MAHUNT ATTACHMENT C Part II Activities and Operational InformationItem 1: Detailed and narrative description of organizations activities: receiving the 501(c)(3) designation shall be dedicated to the above described activities. These percentages above exclude MAHUNT's subordinate entities covered under a. above. g. To ensure forever that the original property/habitat and all future property(ies)/habitat of MAHUNT stay asoora. Two (2%) percent of the resources and two (2%) percent of the time by everyone who contributes time or money to MAHUNT and the caretaker(s) shall be dedicated to this purpose for every day of the year forever, beginning as soon as possible upon receiving the 501(c)(3) designation. As Henry David Thoreau stated: "Life consists with wildness...The most alive is the wildest...In Wildness is the preservation of the World." POLICIES AND PROCEDURES: The following Policies and Procedures have been adopted by the Board of MAHUNT to assure that the purposes and activities of the Foundation are carried out in the manner intended to satisfy 501(c)(3) of the Code and to preserve and protect the property(ies)/habitat and missions of the Foundation. CRITERIA FOR ACQUISITION/DE-ACQUISITION OF PROPERTY(IES)/HABITAT 1. Close proximity to urban/suburban areas for easy access by a substantial number of "everyman/everywoman" that contain an appreciable, unique or shrinking type of habitat where hunting/trapping is legal. This focus is accented in part by a scientist at the December 1998 Anthropological Society of America's meeting in Philadelphia who noted that aerial and satellite views of urban centers taken over a period of years bore a striking similarity to images of cancerous tissues (particularly melanomas) invading healthy surrounding tissues. FORM 1023 Application for Recognition of Exemption MAHUNT ATTACHMENT C Part II Activities and Operational InformationItem 1: Detailed and narrative description of organizations activities: 2. Located contiguously to public land/parks, conservancies and land trusts, especially where those lands' rules do not allow hunting/trapping, while legal hunting/trapping may occur on MAHUNT property(ies)/habitat. 3. Situated around or encompassing a particularly pristine area where a minimal amount of public land, conservancies, and land trusts exist so that a sizeable block of property(ies)/habitat could be assembled over a period where hunting/trapping is legally permitted. When "per property" is defined for the purposes of admitting only one person plus one human companion, such property shall constitute less than eighty (80) acres. Where property(ies)/habitat exceeds eighty (80) contiguous acres, the Board shall determine unanimously by all existing Board members the definition of "per property," but should attempt to define it so that any up to two persons who commune in (near pristine) nature have a minimal impact from similar communers on the adjacent MAHUNT property(ies)/habitat. 4. Containing the cover, food, minerals, size, location, trespass prevention, surrounding compatibility, and existence or potential characteristics for superb creatures, sometimes erroneously called "trophies," where hunting/trapping for such "trophies" is legal. As Theodore Roosevelt in Outdoor Pastimes of an American Hunter, said "If it is morally right to kill an animal to eat its body, then it is morally right to kill it to preserve its head. A good sportsman will not hesitate as to the relative value he puts upon the two, and to get the one he will go a long time without eating the other." Just as catch and release fly fishing for species like trout, steelhead and Atlantic salmon is deemed a tremendous conservation tactic, so is trophy hunting for animals, since tests show one to three percent of the released fish probably die from the experience, which is about the percent of trophy animals taken from a herd when it is emphasized rather than just meat hunting. 5. Containing no or few buildings or residences where the surrounding land allows legal hunting/trapping. If, however, a home or building(s) do exist on the property(ies)/habitat, the Board shall have the ability to sell sufficient land to remove the Foundation's ownership of the structure, demolish the structure, leave it uninhabited, rent it, or do as a majority of the Board at a meeting where a quorum is present deem the best for the property /habitat. FORM 1023 Application for Recognition of Exemption MAHUNT ATTACHMENT C Part II Activities and Operational InformationItem 1: Detailed and narrative description of organizations activities: 6. Ducks Unlimited has invested resources or has a special interest in such property(ies)/habitat and hunting/trapping is legal. 7. Located in Wisconsin, Iowa, Montana, California, Arizona, Wyoming, Minnesota or Illinois. 8. As with the original property of the Foundation, in all the above instances, the Foundation shall strongly consider erecting on the subject property(ies)/habitat a permanent plaque commemorating the previous owners and/or contributors of the subject property(ies)/habitat and their stewardship of its habitat as well as diagramming the location and attributes of any special features or sites on the subject property(ies)/habitat like Indian mounds or historical events. Pictures or memorabilia of said previous owners and/or contributors or from the subject property(ies)/habitat shall be displayed near or on the subject property(ies)/habitat, or within the museum (the "Museum") presently intended by MAHUNT. 9. Because trapping is illegal in California, the above criteria required for legal hunting/trapping shall only be required to allow legal hunting in California for so long as trapping is illegal in California. 10. The Board may de-acquire any property(ies) of MAHUNT, except the original property, to fund implementation or enhancements of MAHUNT's Specific Purposes and Activities as described in its 501(c)(3) application. 11. In making de-acquisitions, the Board may rezone, divide into parcels (and sell some or all), or petition for annexation, any of its property(ies) to maximize the fair market value received in cash for the property(ies)/habitat. 12. If any direct learning described in Section d. of Specific Purposes and Activities contained in the Foundation's 501(c)(3) application is prohibited, not permitted, or does not take place for twenty-four (24) consecutive months on any MAHUNT property(ies)/habitat, the Board FORM 1023 Application for Recognition of Exemption MAHUNT ATTACHMENT C Part II Activities and Operational InformationItem 1: Detailed and narrative description of organizations activities: may de-acquire such property if the new permitted uses in Section c. of Specific Purposes and Activities of shooting skeet or trap (clay pigeons) are legal and implemented, but the Board shall de- acquire such property(ies)/habitat if no skeet or trap shooting is legally permitted, in the following order of priority: a. To a Native American Nation for the construction and operation of a casino. The Native American Nation shall pay at least the fair market value for the property in cash and shall agree to construct and operate said casino within three years from the sale date. If such casino is not constructed and operating by such date, the property/habitat, plus any additions or construction, shall revert to MAHUNT for $1.00 and other good and valuable consideration, unless all existing MAHUNT Directors vote to waive this reversion. b. To any individual, corporation or entity that agrees to construct building(s) which maximize MAHUNT receiving the highest fair market value in cash for the property. Failure to construct such building(s) within three years from the date of sale shall result in the property/habitat, plus any additions or construction, reverting to MAHUNT for $1.00 and other good and valuable consideration, unless all existing MAHUNT Directors vote to waive this reversion.
CARE OF LAND MAHUNT shall retain and where necessary pay a caretaker(s) to oversee the property(ies)/habitat. Preference shall be given to caretaker(s) who have previously exhibited long-standing diligent hard-working effort on their respective subject property(ies)/habitat prior to MAHUNT's involvement and to their direct descendants in recognition of their devotion and reverence for the land. Next priority shall go to independent contractors that have aided in the subject property(ies)/habitat's preservation, restoration and improvement, especially if they can serve as caretaker for more than one subject property(ies)/habitat. The caretaker(s) can seek assistance from FORM 1023 Application for Recognition of Exemption MAHUNT ATTACHMENT C Part II Activities and Operational InformationItem 1: Detailed and narrative description of organizations activities: volunteers (up to six total in an extraordinary situation) or pay additional independent contractors to assist in sizeable tasks. Mondays shall be the primary day for such "upkeep" and "maintenance" or "cleanup" days when other use shall be precluded. The caretaker shall: 1. Patrol the property(ies)/habitat by viewing it or entering it (if necessary) to minimize and apprehend human and canine trespassers, remembering to minimize noise and disturbance of the habitat. 2. Obtain and keep a lock (with at least three cylindrical numerical wheels) on the gate(s) of MAHUNT's property(ies)/habitat. Such lock shall have its combination changed for each three day period that new authorized entrants shall be able to enter the property(ies)/habitat. The new combination will be sent to the new authorized entrant concurrent with her/him learning of her/his success in the draw or blind cash bid. In unusual circumstances, the Caretaker may leave the gate unlocked when an applicant is scheduled to visit. 3. Provide and maintain a log or hunting log book conveniently available at the entrance to the property(ies)/habitat similar to that utilized in the Wisconsin Wildlife Damage Abatement and Claims Program ("WDACP") and periodically ensure that the authorized entrants have signed and filled out such log or hunting log book. An example of the log book and hunting log book which shall include a map of the respective property(ies)/habitat, a read this before you sign section, and a signature and information page follows this section. 4. When easily convenient to both authorized entrants and the caretaker(s) (but in many instances not required of the caretaker(s)) verify the authorized visitors identity and possession of valid use permits for MAHUNT and licenses when required. FORM 1023 Application for Recognition of Exemption MAHUNT ATTACHMENT C Part II Activities and Operational InformationItem 1: Detailed and narrative description of organizations activities: 5. Determine if anyone violates the rules of usage or regulations of hunting/trapping or trespass for purposes of precluding future admission on any MAHUNT property(ies)/habitat. 6. Conduct and record visits (individuals must sign-in and identify their organization) and educational sessions at the Museum or within the 120 foot semi-circle designated on the original property encompassing the Museum when conveniently scheduled in advance. Caretakers can enter the property(ies)/habitat at any time to exercise their prerogative to enhance the property(ies)/habitat, but they should take special care to not interfere with legal ethical regulated licensed hunters or with other authorized entrants when they enjoy the property(ies)/habitat, remembering that Mondays are the main day for caretaker maintenance when other entrants are prohibited. In recognition of Daphne H. Schneider's long-standing brush and weed removal, numerous reseeding and planting efforts, and mowing and cleanup activities on the original property/habitat, she shall be the chief caretaker of such original property/habitat until her demise. Her children (Jana and James) shall share such duties during her life and then assume them for their respective lives upon her demise. No monetary remuneration shall be paid to the above caretakers for their work. MAHUNT may retain additional paid or volunteer caretakers in its discretion. The caretaker(s) for the original property(ies)/habitat and all subsequent properties/habitat shall: a. Mow grass, remove brush, fallen trees, and limbs to preserve the open wooded oak area like it was when the Native Americans buried there hunted and memorialize it. b. Burn grass/marsh like the Native American predecessors did (on a periodic, but infrequent and necessary only basis) when legally authorized by the local authorities or cut and remove or sell same. c. Eradicate noxious weeds, including but not limited to Canada and bull thistles, burdock, and wild grapes. Reduce, eliminate, or destroy legally and respectfully any and all predators or pests on or over the properties/habitat which damage the habitat, wildlife, its nesting areas, trees, or plants or the land. An example would be beaver that cut down trees, dam up the wetland, and turn the habitat into a muddy hole. Particular attention should be paid to destroying respectfully raccoons, opossum, foxes, coyotes, skunks, weasels and mink which are prime destroyers of upland and migratory birds. e. Plant and protect with wire cages or enclosures native and other trees and plants including: 1. oaks 2. hard maples 3. native nut trees (like hickory) 4. lilacs, flowering crab, and redbud 5. asparagus and ginseng 6. native prairie grasses 7. wild flowers. f. Prepare the land and plant in limited amounts with tractor, plow, disk, planter or by hand and not harvest alfalfa, clover, corn, sorghum, sunflowers, winter or summer wheat, and/or soybeans, remembering that agricultural crops like the above although helping the wildlife do disrupt the (near pristine) nature of the properties/habitat. Such crops shall not be knocked down or manipulated to in any way constitute illegal baiting for Federal Migratory or State Hunting Regulations by the caretakers or any authorized entrants on the property(ies)/habitat and no illegal salt licks/blocks shall be permitted on the property(ies)/habitat. Only under dire economic situations of the Foundation or when the property(ies)/habitat to be acquired is of such large size that farming and harvesting of the crops in some limited amount would actually aid wildlife/habitat shall such harvesting of some of the crops be permitted. Even then the first mowing and bailing of hay should be postponed as long as possible to minimize disrupting pheasant, duck, and other nesting. Ensure that a minimum of noise be made or occur on the property(ies)/habitat, except minimal firing of guns or rifles during hunting, so as to maintain as much solitude as possible. This shall mean that no target practice of bows, guns or rifles may occur on the property(ies)/habitat whether during the open legal hunting season or not. h. Enhance the wildlife/habitat. Activities including (1) installing and maintaining predator-proof nesting enhancement, especially for woodducks, (2) the legal limited release of game birds and animals that have a reasonable probability of enhancing the wild population of such creatures rather than the mere "put and take" aspect of game introduction, and (3) maintaining/erecting fences and gates so that free roaming dogs are kept off the property(ies)/habitat and trespassing is minimized. i. Post and maintain no trespassing signs that outline the availability of the property(ies)/habitat to the public only through the draw or blind cash bid process and where to apply for same. j. Ensure the portable tree stands, refuse/litter, and legal traps of authorized entrants who wish to trap fur bearing animals legally have been removed from the property(ies)/habitat after each three day visitation period. k. Utilize motor vehicles and mowers sparingly on the property(ies)/habitat only when necessary to accomplish the above. A map of this property/habitat is enclosed with this log book for your review -- DO NOT REMOVE. Signing up beyond this moment's date and time constitutes fraud. Failure to provide all the information requested in a readable fashion constitutes trespassing and will result in you and your companion, if any, being prohibited from entering any of MAHUNT's property(ies)/habitat now or in the future. YOU WILL BE HELD ACCOUNTABLE TO THE HIGHEST OF CONSERVATION ETHICS. Any breach of the requirements below will constitute grounds for MAHUNT to deny you and your companion, if any, further access during your present authorized three days or on any of MAHUNT's property(ies)/habitat ever in the future and may result in enforcement action being taken by local Conservation Warden and/or County Sheriff's Department. By signing this Log Book, I certify that I understand and will comply with all of the following: 1. Will minimize the noise that I make or cause to be made on this property/habitat, including when entering this property/habitat both in consideration of the sanctity of the property/habitat as well as the well being of the surrounding inhabitants and properties. 2. Close and secure all gates when entering/exiting the property. 3. Will cooperate fully with the caretaker(s) of MAHUNT. 4. Will NOT access this property/habitat or any other MAHUNT property(ies)/habitat without being or accompanying an authorized winner of the draw or blind cash bid during the three day period covered by such winning entry. Will NOT trespass on neighboring properties. 6. Will NOT bring onto the property/habitat or use any firearm, crossbow or archery equipment in any manner on the property/habitat. 7. Will NOT knock down or manipulate any crops on the property/habitat of MAHUNT and not bring any salt licks/blocks onto the property. 8. Will NOT damage MAHUNT's property/habitat and will take special care to minimize my impact on the property/habitat, endeavoring to leave the property/habitat as close to its condition prior to my entry as possible. 9. Will NOT use any motorized or wheeled vehicle (including but not limited to car, truck, SUV, snowmobile, motorcycle, quad, all terrain, electric golf cart, tractor, or unicycle) on MAHUNT's property/habitat, except to park (one) my vehicle on the property/habitat if necessary and then as close to the entry gate as possible. Physically handicapped persons (denoted by a state authorized parking placard placed prominently on their vehicle's dashboard) may drive on clearly identifiable vehicle paths or roads on the property so long as no snow, soft ground or muddiness exists on such paths or roads. Such persons may also use wheelchairs on the property when snow, soft ground or muddiness do not exist. 10. Will NOT use or construct any permanent stand or blind on MAHUNT's property/habitat and will remove upon my final departure during the authorized three day period any portable stand or blind that I have brought onto the property/habitat. 11. Will comply with all other activity restrictions attached to this sheet determined by MAHUNT for the purposes of preserving safety and protecting MAHUNT's property/habitat. 12. Will NOT remove any artifacts from the property/habitat. The caretaker(s) must be informed of the location of any artifacts in person or by mail as soon as possible. Will record in the Log book each time I sign in to enter the property/habitat and will return before leaving the property/habitat to record the time I leave the property/habitat. In no event will I enter the property/habitat prior to one and one-half hours before sunrise nor leave the property/habitat more than one hour after sunset. 14. No dog, cat or other domesticated or pet animal (including but not limited to horse, cow, sheep, pig, llama, birds, rodents and insects) shall be permitted on the property/habitat. 15. No wild animal or bird shall be brought onto the property/habitat. 16. No signs, banners, graffiti, protests, or noise of similar nature shall be brought onto the property/habitat or made on the property/habitat or placed on anything on the property/habitat. 17. No mobile telephones, radios (except the car or vehicle radio, which shall be turned off prior to entering the property/habitat), TVs, music boxes, computers, or similar noise producing products may be brought onto or used on the property/habitat. 18. Will NOT start a fire or strike a match or lighter on the property/habitat. 19. Will NOT litter on the property/habitat or bring chewing or bubble gum or tobacco products onto the property/habitat. 20. Will NOT bring onto the property/habitat any alcoholic beverages or drink, or illegal drugs or use same on the property/habitat. 21. May remove asparagus cuttings (not roots), nuts, and fallen leaves from the property/habitat. 22. May NOT remove any wild mushrooms, puff balls, fruit, or berries from the property/habitat and will release MAHUNT from any liability from ingesting or having anything taken from the property/habitat. Must take all necessary precautions to not be bitten by ticks or fleas, which may carry lyme or other diseases while on the property/habitat. 24. Must take all necessary precautions to avoid any and all contact with any living, sick or dead reptiles, birds or animals or their rubbings on the property/habitat to minimize being bitten, touching prions, contracting rabies, or any other disease or malady like TB. 25. Any sighting of a sick, staggering, drooling, foaming from the mouth or nose, disoriented, or emaciated animal, bird or reptile on the property/habitat should be reported quickly to the caretaker(s). 26. Shall not deface, destroy, scratch or in any way harm any plaques or memorabilia on the property/habitat. 27. Will hold harmless MAHUNT and any one affiliated, employed, or utilized by MAHUNT from liability for any injury or property damage from known or unanticipated risks or causes received while engaged in recreation activities, as provided by provisions described in � 895.52(5), Wis. Stats. and � 29.59(7) Wis. Stats. Be careful when walking in any marsh or wetland or to, near, or in Mud Lake (or on the path/boards thereto) and do not attempt to wade/cross any ditches to both minimize the human impact as well as avoiding falling or drowning. 2. Be careful when walking in the wooded area or near or around the Indian mounds to minimize the disturbance of such sanctified ground and falling on the uneven ground, especially if the ground is soft or muddy. No walking or wheelchair movement upon the Indian Mounds is permitted. 3. Avoid being near any trees during storms, winds, or calm as limbs or trees falling can be hazardous. 4. No climbing is permitted. ANY VIOLATION OF ANY OF THE LOG BOOK'S RULES OR THIS SPECIFIC PROPERTY'S ATTACHED RESTRICTIONS AND WARNINGS shall result in the individual violating such rule (and/or the group that such individual states that he/she represents) paying to MAHUNT treble damages plus legal fees and being prohibited from entering any MAHUNT property/habitat in the future. Any and all individuals signing this Log book hereby agree to such penalties for such violations by signing and entering the subject property/habitat.
